Guiding Principals of Professional Learning Communities Essay

Normally, in a professional larn community also cognise as a PLC, the educators educate together brainstorming ideas, lessons, and activities that allow embody a plan to be implemented all in hopes of the students achievement. A professional encyclopedism community can benefit a schools environment by reinforcing teacher morale and leadership skills. As the school moves forward, every professional in the building must engage with colleagues in the ongoing exploration of three crucial questions that drive the work of those indoors a professional learning community What do we want each student to learn? How will we know when each student has learned it? How will we respond when a student experiences difficulty in learning? The answer to the third question separates learning communities from traditional schools. A PLC can serve as a support system that motivates teachers to follow a guided plan. Educators who are building a professional learning community recognize that they mu st work together to achieve their collective purpose of learning for all. Therefore, they create structures to promote a collaborative culture. This plan can include classroom assistants, parent volunteers, and new(prenominal) school personnel like librarians. The PLC culture can influence teachers through numbers. When teachers come together and have strength in numbers they can support each other, collaborate, and brainstorm the most effective methods and techniques to instruct the students. Even the meterest design eventually translates into hard work. The professional learning community model is a grand design, a powerful new way of working ogether that profoundly affects the practices of schooling. But initiating and sustaining the concept requires hard work. This is where the challenges may arise. It requires the school staff to focus on learning rather than teaching, work collaboratively on matters related to learning, and hold itself accountable for the kind of results that fuel continual service. A PLC will construct a solid intro of committed teachers who are passionate about their career and working with families and fellow colleagues. The benefit(s) of a PLC is that everyone has the opportunity to be involved and share goals and positive learning experiences of the schools learning environment. When educators do the hard work necessary to implement these principles, their collective ability to help all students learn will rise. If they fail to demonstrate the discipline to embark on and sustain this work, then their school is unlikely to become more effective, even if those within it claim to be a professional learning community. The rise or fall of the professional learning community concept depends not on the merits of the concept itself, but on the most important element in the improvement of any school the commitment and persistence of the educators within it. In conclusion, educators who work together form structured atmospheres that promote learning. References Barth, R. (1991). Restructuring schools Some questions for teachers and principals. Gender Communication Essay

The concept of familiar design is often poorly differentiated with sex, at times hitherto being utilized synonymously with sex. The terminology gender commonly appears within both popular and academic discourses regarding brotherly event dynamics. However, regardless of the form in which the term appears, authors seldom specify what they imply by the terminology. It is widely assumed that readers and listeners already comprehend the connotation and hence explanation is ruled out as being unnecessary. The sex/gender disparity embodies round feminists attempts at breaking the link between the organic sex category and the social gender category. As per this social molding viewpoint, gender refers to the customary sense which ultimately becomes dependently linked to the body. When gender becomes understood to be culturally molded, it becomes worryly to outfox the essentialist tactual sensation which suggests that gender emanates for the organic body (Clancy, 2004). However, despi te the fact that the disparity between culturally molded gender responsibilities and ahistorical organic sexes attacks the idea that females organic configuration come up their social fate, it encounters some difficult dissociation of culturally-derived genders out of sexed bodies.Women and men exhibit dissimilar but similarly valid communication styles. The speaking modes displayed by both women and men have gender differentials. Essentialism belief holds that, since biological disparities between men and women exist, men and women argon obviously dissimilar with regard to genius and character. Strict organic essentialism proposes that ones gender construction is not influenced by nurture. Essentialists assume men to be aggressive, strong, violent, logical, brave, lustful, independent and disciplined.Conversely, women are viewed as being passive, weak, cowardly, gentle, emotional, having no sexual appeal, having no stamina and self-control plus extremely invested in their associ ations with former(a) persons. Aristotle suggested that men are more courageous, virtuous and noble as compared to women. The 1900s saw philosophers like John Locke and Emmanuel Kant argue that the social separation of female and male gender is reasonable owing to the innate disparities between female and male bodies.Scientist in the 1900s study studies on female and male bodies and proposed that since male craniums were bigger in comparison to female craniums and feminine pelvises proved bigger than masculine pelvises, males are more worthy for business, politics and general community life, whereas females whose little craniums supposedly signified lesser intellect, were most suitable to child bearing and home tending (http//www. humboldt. edu/mpw1/gender_theory/perspectives4. shtml). The ramifications of essentialist gender perspectives are extensive.Conventional gender responsibilities are somewhat based upon some fundamental organic determinism a viewpoint that views biology a s being destiny. Consequently, females have had the promontory responsibility of housework and parenting, with men being the wage earners. Even presently, males outnumber females in government and business and women and girls are not as powerfully urged to practice occupations in science, technology and math as are men and boys. Essentialists hold that gender is the same as sex, or that the twain concepts are naturally-derived (God-given) and indivisible.Gender and apparent sex indicators, such(prenominal) as, vagina and penis are inseparable. This theory holds that merely two gender types exist from birth and they are not altered throughout life. No continuum exists between these two genders since any appearances or behaviors not coherent with such suppositions are considered as being perverse. Essentialism holds that females are dissimilar with men owing to their anatomy, in particular their minor sex traits, hormones plus reproductive structures.Gender disparities in oral ca pability and visuo-spatial, aggression plus other actions, as well as other mental and physical characteristics are attributed to pubertal or prenatal hormone contact. Essentialist stances may exist within developmental psychobiological, sociological, neuropsychological and ethological work. Magnetic Resonance double (MRI) female and male brain picture Disparities or other mental aspects, for instance, are at times regarded as mirroring inborn disparities.Gender disparities in spatial, verbal and Mathematical capabilities are usually regarded as being organically based (http//www. humboldt. edu/mpw1/gender_theory/perspectives4. shtml). Constructivists hold that gender as well as sex are derived from social relations and do not exist without social contact. It admits social influences upon persons gender. It assumes that manhood or womanhood implies endorsing some general function unique to an item-by-items sex. Personal uniqueness, sexual inclination, as well as modes of socially interacting is determined by some set of individual constructs. This implies that gender and sex do not have natural foundations because nature itself is essentially socially defined. The constructivist quality of Gender and sex is rendered invisible through typical social life dynamics and this makes the two notions seem natural as opposed to artificial (Gergen, 2007). Persons construct fresh knowledge, through assimilation and accommodation processes, out of the experiences they undergo. Assimilation involves integrating fresh experiences into previously existent frameworks with no alteration of such frameworks.Such events could demote when persons experiences reflect their inner realism examples however, they may as well happen whenever alteration of some defective understanding happens, for instance persons may fail to detect events, could misinterpret others input, or could conclude that some occurrence is offer some unimportant information regarding the world. On the contra ry, whenever persons experiences disagree with their inner representations, they could alter their viewpoints of such experiences with a view to conforming to their inner representations.Accommodation involves restructuring ones intellectual outside world interpretation to suit fresh experiences (Glasser, Smith, 2008). It is the means though which learning emanates from failure. When persons act based on the anticipation that the world functions in some specific path only for such expectations to be violated, such individuals usually fail. However, through accommodating such fresh experience as well as restructuring their model regarding the operate of the world, persons learn through experiencing disappointment or the failure of others. .Constructivists suggest that gender representations systematize an individuals in-personity uniqueness, social awareness and interpersonal actions. The notion of classifying as either female or male is the vital initial action in the classificat ion of human beings following birth, and owing to contemporary technological advances, even some months prior to birth. Sexual inclination whether bisexual, homosexual or heterosexual, at puberty it too viewed as a vital gender representation element that is vital to interpersonal actions and societal lives (Rosser, 2003). men interact with the world as persons within hierarchical communal order whereby they are either place down or up. Conversations in Such worlds comprise of negotiations whereby persons attempt to attain and uphold the dominant position when they can, as well as shield themselves from the attempts of others to contract them about and drag them down. Life, in such circumstances comprises of some contest or efforts to uphold autonomy and evade failure. Women approach the world as individual within some system of linkages.Ni such a world, dialogues comprise of consultations for intimacy whereby persons attempt to look for and offer support and confirmation, as wel l as to arrive at a consensus. Persons attempt to shield themselves from the attempts of others to drive them farther. Therefore, life consists of some community and efforts to uphold intimacy as well as evade segregation. Despite the fact that hierarchies exists in such world too, such hierarchies are associated more with friendship as opposed to accomplishment and power (http//openlearn. open. ac.uk/mod/ resource/view. php? id=166569). Females too are inclined towards attaining status as well as evading failure, however, such objectives do not occupy all of their time, and women seem to seek for such goals while disguised as maintaining connection. Men too are inclined to attaining participation as well as evading segregation, however, they do not focus on such objectives they seem to seek for them while disguised ads opposing them. Thus, Women and men seek entirely different entities during communication, and they as well functions as per varied rules.Mens self-worth originates f orm the capacity to attain outcomes whereas womens self-esteem originates form her sensations as well as the fineness of their relationships. Therefore, women fair better in personal contact and communication communication has primary significance (Armstrong, 2006). For womenfolk, relationships take precedence over technology and work. Individual expression, particularly regarding their emotions, is extremely crucial. Sharing of personal emotions has greater significance than attaining goals as well as success.Interpersonal contact and talk grants tremendous satisfaction. References Armstrong, A. (2006). Since the advent of industrialization, most to these aborigines were forced to transfer and move and rough of them are now in towns living a very bad condition of life. In some countries, they work as low-class laborers and in some countries, they live as pan-handlers and beggars in golf club to keep up with their lives.Country200520062007Australia400,00 0517,200450,000Canada938,8001.1M1.2 MTaiwan398,000379,000484,00Looking at the above table, it may be noted that though aborigines have not been treated equally as the rest, the population has been high further in the past two years, there was a gradual decrease in their population because of certain diseases that were not given much attention to. These people are said to be the original land-owners but most of their lands were stolen to them. Fortunately, there are laws now protecting the aborigines. In Australia, British people claimed that when the invasion happened, the land was vast and empty.Fortunately, there are laws now that aims to protect the rights of the aborigines and there were bills saying that their lands should be returned to them. There were some who are calm down against this bill saying that the lands result end up useless if given to them and that these lands should never be returned to these people. Some were even massacred and others because they are being deprived of the basic rights either commit suicide or died because of the disease such as cholera and other epidemic.Compared to others, these people have high compute of birth and suicide as well (Aborigines 2008). Some people see the essential to give them screening their lands and recently, the problem and the call of these people has been addressed through tourism. Some of them now have already secured self-possession of their lands and were given the signal to go back under certain conditions and terms as stipulated under the judgment of global tourism. The question is if they are going to cooperate with these terms and conditions.Global Tourism and the AboriginesCulture and tourism can never be separated. Since the advent of technology and industrial revolution, culture seemed to be drifting outside or is becoming independent of tourism. Now, there are many amusement centers such as Disneyland, celluloid tourist attractions and sightseeing but what most people are looki ng for now and are need to see is something that would connect them and link them to the past. This is the start of aboriginal lands being converted into cultural attractions. In Canada and in Australia, many cultural attractions have been built and these places are continuously drawing the attention of mass tourists. To some aborigines, it is good and government started talking with them and the start of global tourism also implied the beginning of renewed bank for these people. Some lands were converted to attractions and people go there everyday to see how aborigines cultural heritage. cardinal sectors and organizations have been established and the commendable development is that most of these sectors encourage cooperation with government and society. Now the government recognizes the opportunity for travel and the importance of culture as part of travel.Educational tourism also recognizes the importance of these people and most institutes and schools se them to educate studen ts who were long been taught of history and culture. Because of these, aborigines were also given the chance for breeding unthe likes of before when they were all illiterate and uneducated. If in the past, these people were fearful of others and vice versa and cooperation and coordination is now seen. nearly of them have now decent forms of survival. They are not and in their lands they were also slowly and little by little being exposed to others which is a good thing for them.Nowadays, aborigines have been gradually rising and they are now playing a very important role in the society. Looking at the graph above, the property of aborigines is now becoming greater. The properties of aborigines now campaign from corporations down to private enterprises. The Causes of Global Tourism to Aboriginal SectorsIn 1999, a group was held and presented to the WTO or foundation Tourism Office. This conference was about the Global Code of morals for tourism (The Global 2007). Accordingly, there is a continuing desire and goal in tourism to play a very essential role in rationality the cross culture. It was said in this conference that through the direct and straight spontaneous contacts engendered by different lifestyle and cultures, the merely way to play these people meet is through tourism. Nowadays, many indigenous communities now participate in tourism-related activities to further reserve the revival meeting of culture as well as to sustain the economy and to further understand the cross-cultural needs and differences.Indeed there is an underlying relationship between culture, indigenous heritage, and the themes for interpretation, authenticity, traditional lands protection, IPO or Intellectual Property Rights and the evidence of traditional knowledge. Aboriginal cultural tourism around the world is comparatively young and it is believed that they are still new in the industry. Some may have liked the brain of becoming a subject for studies and tourism an d some do not.The causes of global tourism may be considered two-faced good and bad. To some aborigines, the idea of meeting people of these times is good. They learn to mingle and be appreciated as well. However, this is something new for them and some sociologists and psychologists assert that this may cause these people to be over-shocked and therefore be mentally affected. They are still considered to be different and they are still indigenous in any way we look at it. Their breeding, education, lifestyle, and culture are totally different from the norm. They know this for sure, and like any other minor ethnicities being joined with the many, they also feel different and this is bad for them. This is one reason why some still feel deprived and used inequitably. The mental effect for these people is considered to be a mental outcome of environment. Their worlds were suddenly opened to the universe thus, to comprehend and address the psychological needs of these people is imperati ve. They should undergo counseling, psychological treatment and psychotherapy to be able to reach occlusion with regards to issues about their cultural heritage that haunt them in contemporary times. The Effects of Global Tourism to Aboriginal Organizations and SectorsAccordingly, it of utmost importance to understand the host and tourist relationship and there are some disposed(p) issues to be considered in this regard. Primarily, the reputation of cultural exchange needs to be understood. In some studies made in tourism, it is asserted that activities should be understood between non-indigenous and indigenous people. To tourists and visitors, the effect is good because their awareness, appreciation and understanding of the aborigines are improved. The used to be harsh and fear-filled relationship is changed because tourists become aware of the underlying needs of these people. However, to aboriginal sectors and organizations, there is a critical perspective to create cross-cultur al understanding and education among various cultures. The questions that need to be answered are the followingWhat is the nature of the activities that are to be done?To what extent will these people (aborigines) be used for global tourism and to what extent will global tourism be used by these people (aborigines)? What are the mechanisms and processes that need to be utilized to make sure that interpretation are laid in a sensitive manner? How important is education in recognizing the connection between various cultures? As many analyze this situation continuously, the very important factors that could give good effect to these aboriginal sectors and organizations are the following (Aboriginal 2007)cultural tourism industrycross-cultural understandingcultural revivalpolicy, legislation and committeesconsent and the recognition of deedsoperating agreements and shared revenuesmanagement training, skills and authenticityindigenous view and identityconsultation process, protocols and st atusHow to Sustain Cultural TourismAboriginal sectors and cultural tourism are always connected. There is an authentic and real depiction of the cultures of the aborigines in such a way that the effect on culture and community will not have a negative long-term effect. Accordingly, in order to support and sustain the cultural tourism, there should be a focus in owning, sustaining, as well as accepting the desire in which the aboriginal sectors and organizations are affected. This is also extremely important in sustaining the economic activities. However, though these needs are named, there are still elements that need to be addressed and that is to fill the gap between the barriers to support the economic and infrastructure operations. The Type of Cultural flip between Aborigines and Global TourismThere are different ways in which the cultural tourism is managed and the most important part of it is the cultural exchange between global tourism and aborigines. First and foremost, it i s very important to understand the types of the cultural exchange that occurs and how to support or work on them. The reason for this is that there are many types of aborigine and that the way they are treated and educated should also be different. Accordingly, the most important thing to overcome is the traditional knowledge. The traditional knowledge includes storytelling, oral history, teachings of the elders and contemporary exhibits and displays. There are also traditional cultural presentations, traditional teachings, historical reenactments and food preparation. The information about these is treated separately. These things can be addressed by many formats, guidelines, guided tours, audio visual presentation and interactive workshops. momentous emphasis should also be given and to avoid problems and conflicts. This is to provide boundaries between the cultural practice and sacredness thus best practices should be ensured. What are the Best Practices to be Observed? In order to develop and take in the cultural heritages and programs, it is necessary that certain tools and mechanisms be used. The very first mechanism should be predominant in ensuring the cultural products authenticity and the community based processes should be recognized. Because the aborigines follow a community based relationship, decisions should always be approved by the elders before going ahead with the operations. In souvenirs and cultural products description, there should also be recognition in the participation of these people. Moreover, the history by which the cultural tourism in a certain place that includes the aborigines should also be recognized, introduced and emphasized. This way, these aboriginal sectors and organizations will not be bypassed.ConclusionThe relationship between global tourism and aboriginal sector cannot be separated much more on the basis of the evaluation of the long-term implications of global tourism on aboriginal sectors and organizations and vice versa. While it is original that there are many things that are mutually beneficial in such a relationship, it is still very much essential to take hold of the bad effects and find ways on how these will be overcome.Aboriginal sectors and organizations are composed of human beings that are not different from us. The only difference that lies between the aborigines and common people is the fact that they are born with a different culture and that in the past they were shattered and deprived of their own lands by colonizers and invaders. Understanding these things will tending us address their needs and will greatly help in the empowerment of the global tourism industry. The only key is understanding and give and take relationship. With this, both sides will benefit the aborigines who will benefit from get back their lands at the same time being given jobs and means for living, the business entities who also get profit from their business and from tourism, the visitors and tourists being greatly aware of the culture and cross-cultural diversity and lastly the nature that is given much care by the people who lived in these places originally and at the same time being taken care of by people who are starting to be aware of their needs. It is quite a simple to do all these things. Proper knowledge, education, increased awareness and respect are the key factors that will create a good case which will be positive and sustainable for all parties involved. honorable mentionsReferenceCanada Government. Legal Environment Essay

Sexual torture is always a legal proceeds in the work environment because the ramifications be so severe, just now at the same time very abstract to describe what put up constitute informal curse. This paper will take into consideration diametric elements of the law including Employment Law and cases tried before the U. S. exacting Court. It will also offer suggestions for disciplinary transaction pertaining to the trim of informal torment in the workplace. In corporate America, knowledgeable badgering is a huge concern amongst m each(prenominal) organizations. The matter of sexual harassment is an issue that needs to be directly attended to in baseball club for companies to avoid large costs associated with lawsuits stemming from eachegations of being sexually harassed in the workplace. Sexual harassment is usually an immediate upon. According to Crucet et al. (2010), sexual harassment can cause damage to a companys representation, status, customers, as well as their proceeds. Sexual harassment can be identified as any unwelcome sexual jesters or advances, request for sex, and/or any physical or verbal conduct that may be considered in a sexual nature. The legalities circling sexual harassment can be broken down into two particular categories. According to Crucet et al. (2010), the graduation exercise year is spate pro quo and the second atomic number 53 consists of a offensive environment. The first category of quid pro quo (this for that) sexual harassment usually involves an employee and a supervisory program because in most situations lone(prenominal) supervisors gather in the power of hiring and firing an employee. It also involves some express or implied linkage between an employees endurance to sexually oriented behavior and tangible pipeline consequences (Mallor et al. 2010, p. 1328). An exercise of quid pro quo could be related to a supervisor telling his distaff employee that if you do this sexual favor for me, then you will be promoted.According to Tyner & Clinton (2010), new(prenominal) examples include managers requesting sexual favors, and the receipt or non-receipt of those favors as a condition for qualification hiring, termination, promotion, and other placement decisions. Quid pro quo is easier to identify than strange environment harassment. The second category of sexual harassment is called hostile environment harassment. According to Mallor et al. 2010), hostile environment harassment, occurs when an employee is subjected to unwelcome, sex-related behavior that is sufficiently severe or pervasive to change the conditions of the victims employment and create an abusive working environment (p. 1328).The make out element of any type of harassment is unwelcomed sexual advances unless in hostile environment harassment it is definitely a bit tricky and at times hard to define (Tyner & Clinton, 2010). Both categories of sexual harassment violate Title septette of Employment Law that is in place to protect correspond opportunity in the workplace. In order to avoid or limit their liability for sexual harassment allegations, an employer must act immediately when issues of sexual harassment be brought to their attention in addition to providing adequate training on sexual harassment along with having an effective policy in place that identifies the glossary of sexual harassment. A current ethical situation that I have encountered in the workplace involves hostile environment harassment. I have an employee by the name of shilling Doe that has been accused of sexual harassment in the workplace. sorrel has been working as an Admissions Counselor at a lower place my supervision since January of 2011. curtsey is married with trio young children between the ages of ten to sixteen. curtsey is a great worker but people allay feel uncomfortable around him and comes off much different that the other male employee or co worker. He carries around an aura or vibe tha t makes the female employees feel uncomfortable. For instance, when Bob has a confabulation with other female employees he tends to get too close and invade soulal space. He is a good deal caught wording vulgar and raunchy comments that are HR unfitting and has a habit of speaking under his breath a luck. Many of the female employees have claimed that he stares at them for periods of time without saying anything. He is medium to tall height, with a muscular build and tends to wear tight articles of clothing to reveal his muscles. Bob is middle aged and is about 5-10 years older than the average of other Admissions Counselors. In August of 2011, one day a nonher male employee approached me and said that Bob had made some remarks to him regarding some other female employee.Bob told this male employee that he would love to catch her d hightail itk about that female employee. As a supervisor, this remark made me feel very angry that one of my employees would make comments like tha t about a nonher employee and I immediately get overed this action to my Director, Steve. Steve said that he really couldnt do anything about that comment because I could not confirm whether or not he said it based off of the record book of another employee and that the comment was not heard by the female employee. The director then told me to stay onward from the gossip in the workplace and not to get involved in drama, He reminded me that I am suppose to be above that sort of office slander and that I was put in this authority to make others people at their job and not be a whistle blower. I adjudge what he told me and agreed that I would do a better job moving forward, but I still asked him to please report this accident to homosexual Resources. Steve said that he would handle the situation and would report the incident to Human Resources.Steve likes to handle all HR issues as he calls, in house. Steve wants the managers to run an incident by him before going to HR because he feels that he can handle the issues and that only if the cause was serious enough and if he was not present then we could go to Human Resources, differently we were to seek his approval or direction first. The second incident that involved Bob was in November 2011, when he approached another female employee on the aggroup and grabbed her from behind and hugged her.Although he was not being overly in-your-face and had a smile on his face, the female employee named Helen was caught off guard and felt violated and asked Bob not to touch her again because it made her feel uncomfortable. Bob laughed it off and said Gezz girl relax You get laid its not like that and pointed at his wedding ring and walk away. Helen approached me and told me what happened. I immediately pulled Bob into a conference room and told him very sternly that it was inappropriate to hug and/or touch another employee in the workplace especially if it is unwelcomed because it could be viewed as sexual harassmen t.He said he dumb and apologized for his behavior. At this time, I felt that this particular incident did not need to be reported to Human Resources since I felt I had a pretty good handle of the situation. I, however did document the incident in his employee activity log and mentioned it to my director who also said I handled the situation appropriately The triplet incident that happened regarding Bob was in January 2012. Bob was flirting with a female employee named Lisa who was not an employee on my squad but still in the same division. Bob then began to grab Lisas hand and study it with his hand.As Lisa pulled away, she asked Bob why are you trying to hold my hand? Bobs response was youre so hot youre making my hands clammy. This was another sexual harassment issue that could have blown up. at once Lisas manager brought this situation to my attention, I once again called Bob into the conference room and explained to him that this was his second warning not to touch anot her employee, especially a female employee because it is inappropriate and unwarranted and if it were to happen again, then I would have no choice but to personally report him to Human Resources.Once again, I turned to my Director, Steve to seek his advice. Steve again told me that as long as you feel that you handled the situation appropriately and documented it then Bob should be fine. At this point I started getting the feeling that Steve didnt care about the safety of my female employees and that he just precious to avoid HR to avoid a situation. I felt as if Steve was allowing this to happen to pr evet himself from expression bad. I then decide that I had to take the situation into my own hands and be much cognizant of Bobs behavior with other employees. There have been a number of other times that Bob continued to make inappropriate comments to other female employees. He would compliment girls on their dress and say how nice their legs looked or that a certain color really b rings out their figure. However, thither were no mo complaints from Bob in regards to touching another employee inappropriately. He eventually decided to hesitation onto another role with a different company and that was that. Sexual harassment is subjective because anyone identifies and perceives sexual harassment differently.Bob did come from the food and beverage industry where he was a bartender and a lot of his employees were cocktail waitresses in a night club in downtown. He did mention that in his previous job that he was very friendly with his staff because the culture would be much tolerable, especially with alcohol being involved. So, he may not have viewed his actions as being sexual harassment to his female employees, but obviously the employees felt otherwise. Author Tyner and Clinton write that According to the law, the victim must be a honest person (Tyner & Clinton, 2010).The well-founded person standard initiated in the landmark case of Rabidue v. Osceola Ref ining back in 1986. According to Tyner & Clinton (2010), in this case the majority ruled that vulgar language and the sexually oriented posters did not result in a working environment that could be considered intimidating, hostile, or offensive under the guidelines. fundamentally Judge Keith felt that sexual harassment should not be judged by a reasonable person but rather by a reasonable victim (Tyner & Clinton, 2010).It is the victim that feels uncomfortable and is claiming the allegations of sexual harassment. They are the one that feel that the acts of another are unwelcomed and violating their legal rights. Unfortunately, as a manager of fourteen Admissions Counselors, at times I dont have the presence to be everywhere at all times. I have frequently not been present at urgent moments because I was helping or assisting another employee. I always made it a conscience effort to praise in humankind and coach or criticize in private. This was the course of action I took with Bob w henever I witnessed an inappropriate behavior from him. I took him into the conference room and let me dwell that what he just did is not welcome. I did not want him to feel that he was being discriminated against because he was an older male. I know that it was my ethical duty to make sure that all of my employees have the right to feel safe in the workplace. This root word really sticks out to me because as a manager of a big company we are always having sexual harassment trainings and seminars on how to identify and prevent instances from occurring.A manager at the training share with the rest of the managers a horrific case of sexual harassment from one of her employees. The employees name was Tim and he was a very skilled and tenure Admissions Counselor and often looked at as a great example of a successful hard working Admissions Counselor. When a female new hire Kristy was added onto the same team as Tim the manager advised that the new hire learn from Tim and create bes t practices and habits that Tim has. Kristy was near Tim a lot because she was given orders to learn from Tim.Tim would use this opportunity to flirt with Kristy constantly and asking her very go in questions about her personal life such as, if she is dating anyone or if she is interested in a alliance or just hooking up. Kristy became very ucomfortable when Tim started to text message her at night saying that he is bored now that he is divorced and that he wants to meet her early in the morning to go over performance strategies. When Kristy finally confided in another employee the manager was brought to attention. The manager immediately told Kristy to go to HR right away and the manager went to her supervisor and they both took immediate actions. Because of Tims behavior Kristy was about to diverge her job and she would attempt to be sick in order to stay away from Tims desk. Tims behavior created a hostile environment because Kristy was in fear of encountering Tim. This incide nt not only saddens me for Kristy, but also made me sad because of what Bob had done in the past to my fellow employees and I had not taken immediate actions like I should have.Legal Viewpoints The U. S. dictatorial Court According to Crucet et al. (2010), in 1980 the Supreme Court said that sexual harassment was a breach of the Civil Rights Act of 1964. Title VII of the Civil Rights Act of 1964 prohibits discrimination based on race, color, religion, sex, and national origin in hiring, firing, job assignments, pay, gateway to training, and apprenticeship programs, and most other employment decisions (Mallor et al. , 2010, p. 1323). An important case that first appeared the reasonable person argument was in the Rabidue v. Osceola Refining in 1986 mentioned earlier in this paper. This case is often cited as the predecessor to the landmark Supreme Court case of Ellison v. Brady in 1991. In Ellison v. Brady (1991) the Supreme Court rules that it is unreasonable to use a reasonable per son standard since the rules were established by men (Tyner & Clinton, 2010). This is where the reasonable victim came into existence. The court went on to say that we note that the reasonable woman victim standard we adopt today classified conduct as unlawful sexual harassment even when harassers do not realize that their conduct creates a hostile working environment (Tyner & Clinton, 2010).This Supreme Court ruling is of great importance. Many of times, harassers dont even realize what they are doing is wrong because their perception of reality is off. Two important Supreme Court cases in 1998 created the framework for deciding whether or not employers were held liable for sexual harassment pull by its employees. The first was Burlington Industries v. Ellerth (1998) and the second was Farragher v. Boca Raton (1998). According to Cabassa (2011), employers in jurisdictions where courts have allowed indemnity claims against employees for actions giving rise to harassment cases are o n the rise. There are many cases linking to sexual harassment in the workplace that they have launched a litigation committee that covers employment law to covering all legal issues related to the employment relationship (Cabassa, 2010). The question still stands on whether or not a company is liable for sexual harassment committed by one of its employees. The answer to that question lies on whether the harasser was a coemployee or a supervisor of the victim, whether the victim suffered tangible job detriment and whether the company had sexual harassment policies, training, and grievance procedures (Mallor et al. , 2010, p. 1328).Therefore, in order for a company to release themselves from association and allegations of sexual harassment a number of things need to be considered. Suggestions for Corrective Action According to Das (2007), sexualization itself, as a precursor to signaling, could arguably stem both from a targets developmental trajectory and from later-life experiences that get layered onto this basic personality substrate. Therefore, although Bob had these precursor passing play of sexualization prior to him going through divorce, the later-life experiences of divorce layered into his life may have caused him to be more relentless.Regardless of his personal life experiences, Bob needs to be in line with the Employee Handbook and issue forth its policies. It is imperative each company have a Human Resource or Employees Relations vocalization that can handle any allegations of sexual harassment. It is first and foremost important for a company no matter of size small or large, to have an Employee Handbook in place to identify what is considered acceptable and what can be recognized as sexual harassment. Then adequate training needs to be in place to help identify what may be considered as sexual and/or ostile environment harassment. After the training, each employee should be required to sign off on an acknowledgment form acknowledging that they know and understand the sexual harassment policy. Once those guidelines are set then it is important for managers and supervisors to take the allegations of sexual harassment very seriously and prevent any further occurrences to take place. If allegations of sexual harassment are made, it is important for Human Resources to open an investigation immediately to determine the facts of the case and to get each sides of the story.Once the pieces of the puzzle are in place, then the next step is to take appropriate disciplinary action up to and including termination of the harasser. This measure will hopefully prevent sexual and hostile environment harassment. proof In conclusion, the Employment Law has been established by Title VII of the Civil Rights Act of 1964 allowing every person the right to pursue a career and economic gain with the absence of sexual harassment in the workplace. The U. S.Supreme Court has been a huge help in identifying the law surrounding and rendition the U. S. Constitution as it pertains to sexual harassment. According to Tyner & Clinton (2010), the Society for Human Resource Managers reported in 2002 that 97 percent of employers have written sexual harassment policies and that 62 percent of those employers provide training on sexual harassment. Therefore, as a society we are on the right track to preventing harassment of any type in the workplace especially unwelcomed and unwarranted sexual advances.
